Ideally, please forward us as much relevant information on the case as possible. Any outstanding issues will be addressed in the prelimenary review.
Following a favourable preliminary review, we will assess in detail the merits of your case and determine if it is generally suitable for a funding proposition. This includes not only a legal review, but also economic, strategic or practical considerations.
During this phase, we conduct a comprehensive review of all relevant documents, which includes close collaboration with you or your client to ensure a smooth process.
Once the financing review has been completed in your favour, we will proceed with negotiating a litigation funding agreement with the claimant and yourself. The funding agreement includes the financial conditions, including revenue sharing and cost budgets.
Depending on the financing requirements, the decission of who will ultimately finance the case, FORIS itself or the fund, will be made on the case-by-case basis.
The funding agreement is then finalised between the claimant and FORIS AG.
If financing via the fund was agreed, the funding agreement would be assigned to the fund, without any changes to the agreed terms. Such assignment will of course have been agreed on with the fund in advance.
Rest assured that the case management will remain with FORIS throughout the duration of the process. We remain your direct and sole point of contact - regardless of whether your case is financed by FORIS or by the fund.
