Affected are all business among merchants or enterprises among themselves.
Amendment by the "Law on combating late payment in commercial transactions" from 22.07.2014, became valid at 07.29.2014.
for commercial transactions that are concluded after 28.07.2014, the default interest rate is 9 percentage above the base rate
This also applies to previously created continuing obligations, provided that the consideration for which a fee is required, is provided after the 30.06.2016 (§ 288 para. 2 BGB nFiVm Art. 229 § 34 BGB ) .
for all other commercial transactions continues to apply the default interest rate of 8 % above the base rate ( § 288 para. 2 BGB aFiVm Art. 229 § 34 BGB ).
